Child Custody and Visitation

A legal custody determination addresses which parent has the right to make decisions for a minor child regarding education, health care, religion, and other major issues. Custody can be awarded as sole or joint legal custody. A joint custody arrangement gives both parents equal standing to make important decisions for their child. However, joint legal custody does not necessarily mean equal parenting time with the child. Often in a joint custody arrangement, one parent is designated as the “primary residential custodian” and the other parent receives “parenting time” or “visitation.” Sometimes in a joint custody arrangement, the parties receive “shared parenting,” which means they receive equal time with the child or children.
